CODE OF ETHICS ON REPOSSESSION

1. As far as possible, the number of authorised repossessors must be minimised unless circumstances warrant any additional assistance.

2. Repossessors should only gain entry into premises with the knowledge and consent of the occupant.

3. Repossessors should be well mannered and decently dressed. They should practise professionalism and ensure dignity is upheld in carrying out their duties.

4. The use of “strong arm tactics” of any kind is strictly prohibited in the execution of their duties.

5. At the time of repossession, the repossessors must issue a standard notice to the hirer, informing him/her of the following :-

* The address and telephone number of the finance company and the
* authorised officers he can immediately contact to resolve any problem which may arise. The repossessors must reasonable time to the hirer to inspect the vehicle and remove his personal items and belongings.

6. As far as possible, repossession should be undertaken in the presence of the hirer or any person authorised to the vehicle to be repossessed.

7. Repossessors should at all times act in accordance with the laws and regulations in the execution of their duties.

8. All repossessors should be informed on the Code of Ethics on repossession and abide by its terms. From time to time, they should also observe any other Code of Ethics introduced by the Association of Hire Purchase Companies Malaysia, The Association of Finance Companies of Malaysia and the Ministry of Domestic Trade and Consumer Affairs.



Kod Etika Pengambilan Semula Hakmilik

1. Seboleh-bolehnya, jumlah penarik semula hakmilik yang dibenarkan hendaklah kecil melainkan keadaan memerlukan bantuan tambahan.

2. Penarik semula hakmilik hanya boleh memasuki kawasan tempat tinggal (premis) dengan pengetahuan dan kebenaran penghuni.

3. Penarik semula hakmilik hendaklah bersopan dan berpakaian kemas.Mereka harus mengekalkan tahap professionalisma dan kewibawaan dalam menjalankan tugas mereka.

4. Penggunaan tektik ganas (kekasaran) dalam apa jua bentuk adalah dilarang semasa menjalankan tugas mereka.

5. Semasa mengambil semula milik,penarik semula hakmilik dimestikan mengemukakan notis kepada penyewa dan memaklumkan perkara-perkara berikut:

* Alamat dan nombor telefon syarikat kewangan dan pegawai yang diberi
* kuasa untuk dihubungi segera sekiranya timbul masalah Penarik semula hakmilik sesebuah kenderaan perlu memberi masa yang berpatutan kepada penyewa untuk memeriksa kenderaan dan mengeluarkan barang-barang kepunyaannya

6. Seboleh-sebolehnya, penarik semula hakmilik hendaklah dijalankan di hadapan penyewa atau sesiapa ynag dibenarkan membawa kenderaan tersebut.

7. Penarik-penarik semula hakmilik hendaklah pada bila-bila masa mengambil tindakan mengikut undang-undang dan peraturan yang sedia terpakai.

8. Semua penarik-penarik semula hakmilik perlu diberi salinan dan diberi taklimat mengenai Kod Etika Pengambilan Semula Hakmilik ini oleh syarikat yang memberi pinjaman dan mematuhi syarat-syarat yang dikenakan. Dari semasa ke semasa, mereka perlu juga merujuk kepada Kod-kod Etika lain yang diperkenalkan oleh Persatuan Syarikat-Syarikat Sewa Beli Malaysia, Persatuan Syarikat-Syarikat Kewangan Malaysia dan Kementerian Perdagangan Dalam Negeri dan Hal Ehwal Pengguna.
